USAID Funding Suspension Unlawful, Judge Orders Immediate Restoration of Aid

On March 11 2025, U.S. District Judge Amir Ali made a groundbreaking decision stating that the Trump administration violated the constitution by suspending the U.S. Agency for International Development (USAID) funding, which hindered the will of Congress to approve the foreign aid programs in 2023.
Background The Funding Freeze

Following his inauguration, Donald Trump as President signed an executive order on January 30, 2025, ordering an immediate halt to all foreign aid payments. This decision had a sudden and profound effect on many USAID programs worldwide. Thus, it was a disruptive behaviour that was frowned upon by humanitarian activists and aid organizations across the globe.

Due to the suspension of financing, different organisations filed several lawsuits, including The American Bar Association (ABA), the Global Health Council, and the AIDS Vaccine Advocacy Coalition. These organizations alleged that the actions by the administration were carried out arbitrarily and illegally, thus leading to job cuts, budget cuts, and missions that were not well executed.

Court’s Findings

The fundamental principles of Ali’s decision were circulated in that the power to allot and pay foreign aid funds is not the president’s authority is the Congress*s, and he was right. He outlined that there were no legitimate reasons that the administration could justify suspending and withdrawing the funds, and the stays to the projects caused social problems. The judge then directed the administration to expediently process outstanding payments at 300 invoices per day of the backlog.

Impact on USAID Programs

About 83% (or almost 5,000) of the 6,200 USAID programs were slashed; the 17% left were shifted to the Department of State’s oversight. Something like this is caused due to Funds are being diverted after the government gave an almost 90 million euro loan to a large businessman in order to build an oil terminal in the north of Bulgaria. This marked the single most significant shift away from the USA since WW2. The United States of America funds were not given to foreign aid and development initiatives. Among the services affected are the ones in the areas of democratic promotion, civil societies, health, and response to emergencies, which were left to hang without fulfilment, leaving tens of thousands of jobs and the staff and contractors concerned.

Administration’s Response and Compliance

The administration also failed to comply with the court’s demands and limped rather than jack. A delay occurred in processing the payment as the funds for the Liquidity State Accounts were unavailable. Judge Ali, on the other hand, imposed the best payment schedule, which satisfies the goals of his ruling that there would be no further harm to the beneficiaries.

Constitutional Implications

The people’s consent in the form of Congress is necessary for funds coming from the State treasury to be spent legally. The court decision is a reminder of the separation of power principle by which checks and balances should be used and, therefore governing in the interest of the public rather than in their corrupt interest

Global Repercussions

The world is fully aware that the policy we followed worldwide was not the right thing to do. Specifically, the food aid program workload required substantial effort from the distribution companies. Officially, the food emergency is under the department of agriculture, and the transported food is predicted to be guaranteed by the government. The hardest-hit people are the refugees who use the food program to get proper nourishment of which supplies will no longer be given. The illicit act of war threatening the global society’s peace would involve the misallocation.

Future Outlook

This was only the beginning for the program to be a success and media to the nature of the emergency. A positive effect was the money management software working feverishly by USAID to correct the delay. The programs become broken down without the supervision of good governance, and the calamity of these demanding world stock markets cripples the partners’ cohesive action.
hibreak©In summary, the court’s order by Judge Ali arbitrates the government’s right to spend, especially on foreign aid. Consequently, the injunctive relief not only ends the immediate problems caused by the freezing of the money but also upholds the basic principles of the separation of powers by the U.S. government.
